Former special counsel Jack Smith made his first public statement in months amid a Hatch Act investigation, rebutting accusations of wrongdoing.
Smith was prompted to respond after Sen. Tom Cotton (R-AR) persuaded the Office of Special Counsel to launch a Hatch Act violation investigation into Smith. Smith and his lawyers, Lanny Breuer and Peter Koski, rejected the allegations in a three-page letter to the acting special counsel, Jamieson Greer, a copy of which was obtained by the New York Times.
“The predicate for this investigation is imaginary and unfounded,” they wrote. “Mr. Smith followed well-established legal principles in conducting the investigations into President Trump, and the courts presiding over the resulting prosecutions have already rejected the spurious allegations that the manner in which Mr. Smith prosecuted these cases was somehow improper.”
The trio added that Smith and his lawyers hadn’t received any inquiries from the Office of Special Counsel.
The investigation into Smith was launched at the beginning of this month, aiming to figure out if Smith, who led former President Joe Biden’s Department of Justice’s classified documents and Jan. 6 cases against President Donald Trump, was motivated by political factors.
Cotton argued that Smith’s attempt to bring Trump to trial as quickly as possible appeared “to have no rationale except for an attempt to affect the 2024 election results.”
Part of Cotton’s cited evidence was his “procedurally irregular” 165-page brief that Smith filed just over 40 days out from Election Day, which Cotton said may violate the DOJ’s “60-day rule” to prevent election interference.
Smith’s lawyers voiced confidence that the allegations wouldn’t hold up to scrutiny.
