Questionable Legality
McAfee’s legal judgment faced criticism too, especially his disregard for material financial benefits and his misapplication of the preponderance of the evidence standard. Noted Professor Alan Dershowitz argued that this alone could merit reversal upon appeal.
McAfee’s assertion that disqualification over impropriety could fall solely on Wade and spare Willis completely was also legally suspect, likely to be contested at higher judicial levels.
The Road Ahead for Willis
While Willis dodges disqualification for now, McAfee’s decision spells potential trouble.
