The Hunter Biden Investigation: Prosecutor Denies Whistleblower Claims
The federal prosecutor investigating Hunter Biden, President Joe Biden‘s adult son, has dismissed claims that the Department of Justice (DOJ) hindered the probe. Delaware’s U.S. Attorney David Weiss, in a letter obtained by CBS News, stated that he was never denied the authority to bring charges in the case.
Weiss clarified that he had not requested special counsel status, which would allow him to file charges outside his district without partnering with the local U.S. attorney. Attorney General Merrick Garland has also denied Weiss’s request for special counsel powers.
The prosecutor, a Trump appointee, revealed that he had discussions with DOJ officials about a potential appointment under a section of U.S. Code dedicated to special attorneys. He was assured that he would be granted this authority if necessary. However, whistleblower Gary Shapley, an IRS supervisory special agent, claims that Weiss announced he had been denied special counsel status during a meeting on October 7, 2022.

Shapley, whose team was removed from the Hunter Biden inquiry after he approached Congress, responded to Weiss’s letter through his legal team. They stated that it made no difference whether Weiss requested special counsel or special attorney authority, as the involvement of political appointees compromised the process.
Miranda Devine, a New York Post columnist, also expressed skepticism about Weiss’s letter, emphasizing that the title is not as important as the powers it confers.
The investigation into Hunter Biden has resulted in a plea deal for tax and gun violations. However, the arrangement still requires approval from a judge.
Weiss addressed his letter to Senator Lindsey Graham, who had sought information regarding the DOJ’s handling of the investigation. The prosecutor maintained that he has never been denied the authority to bring charges in any jurisdiction.
It is important to note that certain details regarding the investigation, such as allegations of a bribery scheme, cannot be disclosed due to the ongoing nature of the case.
Late last month, Weiss responded to a letter from House Judiciary Committee Chairman Jim Jordan, asserting that he had been granted the ultimate authority in the Hunter Biden matter. He also denied any retaliation against IRS officials over protected disclosures to Congress.
