FBI agent’s responses on Weiss’s authority in Hunter Biden investigation contradict each other.
A Top FBI Agent Contradicts Allegations in Hunter Biden Case
A top FBI agent involved in the Hunter Biden case recently testified before the House Judiciary Committee, offering contradictory answers that have raised eyebrows. The leaked transcript of the closed-door interview with FBI Special Agent in Charge Thomas Sobocinski suggests that he refuted key allegations made by two IRS whistleblowers regarding Delaware U.S. Attorney David Weiss and obstruction by the Justice Department.
Contradictory Testimony
Sobocinski stated that he did not recall Weiss telling investigators that he had ultimate authority to bring charges against Hunter Biden anywhere he wanted. However, Sobocinski did admit that Weiss had to seek the cooperation of U.S. attorneys appointed by President Joe Biden to advance the case. He refused to answer questions about Weiss’s approach to other U.S. attorneys in search of prosecution agreements that never materialized.
“It is my understanding, based upon the U.S. Attorney’s Office and prosecutors making that determination, that Delaware was not the appropriate venue,” Sobocinski said during the interview. He added that they were actively exploring other locations.
Process and Approval
Sobocinski explained that Weiss had to go through a process within the Department of Justice to bring charges outside of his assigned district. He mentioned that Weiss would approach other districts, ask if they wanted to join the case, and if they agreed, it would become a joint case. If they didn’t agree, the case would go back to the department, which could then give approval to bring the case in other venues.
Contradicting the Justice Department
The fact that Weiss had to seek approval from U.S. attorneys who could reject his requests contradicts the Justice Department’s position that Weiss had ultimate authority to pursue charges against Hunter Biden since the beginning of the case. Weiss’s recent appointment as a special counsel also raises questions about the department’s position, as the appointment would have been unnecessary if Weiss faced no roadblocks.
Blaming “Semantics and Word Choice”
When questioned about the contradictory nature of his claims, Sobocinski blamed “semantics and word choice.” He argued that Weiss’s need for approval did not mean that the Justice Department had lied about his charging authority.
Impeachment Inquiry and Limited Answers
The leaked transcript emerged shortly after House Speaker Kevin McCarthy announced an impeachment inquiry, which Democrats have criticized as illegitimate. Sobocinski’s ability to answer questions during the interview was limited, as he was only authorized to share that he did not remember Weiss claiming he lacked ultimate charging authority. He declined to answer questions about other aspects of the case, citing the ongoing investigation.
Continued Involvement in the Case
Sobocinski confirmed that his FBI team at the Baltimore field office, which worked on the Hunter Biden investigation before Weiss’s appointment, continues to participate in the case. Weiss has stated in court filings that he intends to charge Hunter Biden with at least a gun violation by September 29.
