Illegal Immigrant and⁢ Convicted Sex Offender Arrested in Massachusetts

An illegal immigrant ​who fled California, where he had been jailed as a sex offender, has been apprehended in Massachusetts.

The Boston office of Enforcement⁤ and Removal Operations,​ a division of Immigration and Customs⁣ Enforcement, reported⁤ that the man was initially ⁣detained last week by police in‍ Waltham, ⁤Massachusetts, after discovering that he was ⁤wanted​ by California​ authorities, according to an ICE ‍ news release.

The man, ​a 35-year-old native of Guatemala, had been sentenced⁣ to three years in ‌prison in ⁣California for engaging in sexual‌ acts with a‍ minor and sexually penetrating a ⁣minor ​with ​a foreign ⁤object. After serving ‌one⁣ year in prison, ‌he disappeared and failed to⁣ register⁤ as a sex ‍offender.

After being arrested ⁢by Waltham​ police and released‍ by Waltham District​ Court,⁢ the suspect was subsequently arrested for immigration violations due to⁢ overstaying ​the visa​ he received in‍ 2011. He will⁢ remain⁣ in the custody of immigration ​authorities until he is deported.

ERO Boston Field Office Director Todd Lyons emphasized,‍ “Convicted sex offenders have no right to hide out in our communities and ‍they pose a threat⁣ to public safety.”

Last year, ERO participated⁤ in a nationwide⁣ operation targeting illegal immigrants who were sex⁤ offenders, resulting ​in the ‍arrest of 138 individuals, according to ⁣an ICE ⁤release.

It is well-known that many ⁤illegal immigrants have criminal records. In fact, ICE’s 2019 annual ⁤report revealed that out of the ​123,128 administrative arrests made by ERO, individuals in this group had a​ total of 489,063 criminal ⁤convictions and pending charges, averaging four⁢ criminal arrests or convictions per person.

In the‌ 2022‍ fiscal year, ERO arrested 46,396 illegal immigrants with criminal histories,⁢ resulting in 198,498⁤ associated charges and convictions. These included offenses such as​ assault, ⁢sex crimes, weapons offenses, ⁤homicide-related offenses, and kidnapping, as stated in the ICE release.

The⁣ summer ​arrest ⁤of Elvis Cristian‌ Hernandez-Ayala further highlights the revolving-door nature ‍of illegal immigrant criminals. Hernandez-Ayala had been deported eight⁣ times after being convicted of crimes including sexual assault and⁢ drug possession, according to Judicial Watch.

Judicial Watch emphasized ⁣that this case “illustrates ⁤the gravity of⁢ the security⁣ lapses⁢ along the⁣ southwest ‌border.”
