Former Supreme Court Justice Stephen Breyer offered his assurance that his former colleagues are not easily “moved” by public opinion.

Breyer appeared on This Week on Sunday to disagree with concerns that the high court has become politicized just as the country has. During his appearance, he quoted Constitutional law professor Paul Freund.

“No judge should or will be moved by the temperature of the day,” Breyer said, “but every judge will be aware of the climate of the season.”

According to Breyer, most judges consider how the world will respond to their rulings, but are not swayed.

“Does that lead to your deciding X rather than not X? Well I can never say never, but rarely,” Breyer said.

Since Breyer retired, the court has been the target of many protests due to its rulings, which have included the overturning of Roe v. Wade in 2022 and ruling against affirmative action in 2023.

The Supreme Court also recently issued a ruling against states barring Donald Trump from their respective ballots this November. It will soon hear oral arguments for Trump’s case of presidential immunity, which is an effort to establish a precedent amid the 88 felony charges against him filed by prosecutors across the nation.

Trump appointed three of the Supreme Court Justices during his presidential term.
