Ed Dept Investigates WI School Over Transgender Shower Incident
The Biden administration is currently investigating a school district in Madison, Wisconsin, following a complaint filed by four freshman girls. The girls reported that an 18-year-old male student, who identifies as transgender, exposed his genitals while showering in front of them in a high school locker room.
The U.S. Department of Education’s Office of Civil Rights (OCR) has confirmed that it is conducting a Title IX investigation into the Sun Prairie Area School District (SPASD) in response to the complaint filed six months ago.
The OCR will remain neutral as it collects and analyzes evidence to determine whether the school district responded appropriately to the report of sexual harassment, in accordance with Title IX. Title IX prohibits sex-based discrimination in federally funded education programs or activities.
The Sun Prairie schools have stated that they will fully cooperate with the OCR’s investigation.
‘I’m Trans, by the Way’
A civil rights law firm called the Wisconsin Institute for Law and Liberty (WILL) filed the Title IX complaint on behalf of the parents of the freshman girls. According to the complaint, the incident occurred when the male student, who claims to be a woman, showered naked in the girls’ locker room while the girls were present.
The girls had seen the male student in the locker room before, as he had previously used the girls’ bathrooms. On the day of the incident, the male student entered the shower area, announced his transgender identity, and proceeded to undress and shower naked in front of the girls.
The girls were shocked and quickly left the showers. They reported the incident, but the school officials failed to investigate it in a timely manner.
Conflicting Statements
WILL alleges that the school district did not offer support or address the incident until after the law firm became involved. The district’s response to the incident has been inconsistent, with one statement condemning the presence of students of one sex in a state of undress in front of students of another sex, while another statement indicated that transgender students would not be forced to use locker rooms corresponding to their sex at birth.
WILL has requested all communications related to the incident, but the district has demanded a significant fee to fulfill the request.
The Wisconsin Institute for Law and Liberty commends the OCR for investigating the allegations and hopes for transparency and answers for the parents and families involved.
‘Parents Have a Right to Fight Back’
The school district claims to have addressed the incident and initiated an investigation. However, WILL argues that the district’s locker room policies are unclear and fail to protect students. The law firm asserts that the district did not comply with Title IX requirements when it learned of the incident.
WILL emphasizes that parents have the right to fight back when schools fail to act in accordance with the law. The law firm urges the Biden administration to conduct a thorough investigation and provide peace of mind to the parents in the Sun Prairie Area School District.

How can schools effectively balance the rights and privacy concerns of transgender and cisgender students in regard to the use of public facilities?
And shower in front of the girls. The complaint alleges that the girls felt violated and uncomfortable due to the male student’s actions.
The incident has sparked a debate regarding the rights and privacy of transgender individuals in public spaces, particularly in schools. Proponents argue that transgender individuals should be able to use facilities that align with their gender identity, in order to ensure their equal access and protection. On the other hand, opponents argue that allowing transgender individuals to use facilities that correspond with their gender identity may compromise the privacy and safety of cisgender individuals, particularly women and girls.
Title IX, which prohibits sex-based discrimination in federally funded education programs or activities, has been at the center of this controversy. The investigation by the OCR will determine whether the Sun Prairie Area School District effectively addressed and responded to the reported sexual harassment, in accordance with the requirements of Title IX.
It is important to note that this incident should not be used to fuel discrimination or prejudice against transgender individuals. Transgender individuals, like any other individual, should be treated with respect and dignity. However, it is also crucial to ensure that the rights and safety of all students are protected.
The outcome of this investigation will have implications not only for the Sun Prairie Area School District, but also for school districts across the country. It will provide guidance on how transgender rights and the privacy concerns of cisgender students can be balanced effectively.
In the meantime, it is essential for schools to create inclusive environments that respect the rights and identities of all students, while also prioritizing their safety and comfort. This can be achieved through measures such as individual changing stalls or gender-neutral facilities, which accommodate the diverse needs of students.
Ultimately, finding a solution that respects the rights and privacy of all individuals involved is vital. It is crucial to engage in open and respectful dialogue to address the concerns and needs of both transgender and cisgender individuals in order to foster a safe and inclusive educational environment for all students.
