Lawsuit filed against Disney over alleged dirty trick in commercial for controversial movie.
Disney’s Latest Indiana Jones Film Faces Lawsuit After Alleged Dirty Trick
Disney had high hopes for its newest Indiana Jones action flick, believing it would be the perfect summer blockbuster. However, not only has the film failed to attract fans, but it is now at the center of a lawsuit.
Even before its release, “Indiana Jones and the Dial of Destiny” faced criticism for potentially setting up a “girl boss” as Jones’ successor in future films. This controversy only added to the film’s troubles.
In its three weeks in theaters, the movie has failed to recoup its massive budget. It has also received mixed reviews, with a disappointing 69 percent critic rating on Rotten Tomatoes.
The weak debut of the fifth Indiana Jones film has been a disaster for Disney. “Dial of Destiny” has become a major flop, while a small faith-based film called “Sound of Freedom” is thriving at the box office.
But Disney’s problems don’t end there. The company is now facing a lawsuit over a backpack worn by Indy in the film.
Outdoor clothing and equipment company Frost River Trading Co. has filed a lawsuit accusing Disney’s subsidiary, Lucasfilm, of using its product without permission. The company alleges that the studio even tried to pass off the backpack as a product from one of Frost River’s competitors, Filson.
The lawsuit claims that promotional material for the movie, made in cooperation with Filson, briefly features a Frost River backpack.
“Lucasfilm and Filson produced a 60-second commercial that prominently featured video clips from Indiana Jones 5, along with actors using Filson’s products. Shockingly, one of the clips included Frost River’s Geologist Pack,” the complaint states.
Frost River argues that this violates the Lanham Act, a federal trademark law.
“Liability under the Lanham Act for misappropriating Frost River’s products is a boulder that Lucasfilm and Filson cannot dodge,” the company asserts.
In the lawsuit, Frost River is seeking $75,000 in damages. While this may not significantly impact Disney’s finances, the company has already lost nearly $1 billion in the past year.
Disney’s latest Indiana Jones film has not only been a disappointment at the box office but has also landed the company in legal trouble. With its financial struggles, every setback hurts.
