He pointed to Trump’s request for more than $6.2 million in attorney fees from Fulton County after an election‑interference case was dismissed following the removal of District Attorney Fani Willis over an improper relationship with a special prosecutor. Concha noted a Georgia law now allows defendants to seek reimbursement when a prosecutor is disqualified and the case is dismissed, and he called for broader tort‑reform to curb what he described as the weaponization of the justice system. He also said special counsel Jack Smith should reimburse Trump for legal costs tied to other prosecutions and argued the 2024 election showed voters saw those prosecutions for what they where.

Washington Examiner columnist Joe Concha said the prosecutors who pursued cases against President Donald Trump should have to pay back all of his legal bills for “wasting his time.”
“They tried to take out Trump, not at the ballot box, but in the justice system that clearly was trying to tip the scales for the Democratic Party to get Kamala Harris elected,” Concha said on Fox Business’s Evening Edit.
Trump is seeking reimbursement for more than $6.2 million in attorney fees and costs from the Fulton County, Georgia, District Attorney’s office after the election interference case brought against him was dismissed.
Fulton County District Attorney Fani Willis was removed from the case in September 2025 over her romantic relationship with special prosecutor Nathan Wade. Willis lost an appeal at the Georgia Court of Appeals, which cited an “appearance of impropriety” over the relationship.
Trump is able to request reimbursement for his legal fees because of a law Georgia state legislators passed last year.
The law states that defendants are entitled to request “all reasonable attorney’s fees and costs incurred” in their defense if a prosecutor is disqualified from a case because of their improper conduct and the case is then dismissed.
Concha said that tort reform is needed in the United States to end the weaponization of the justice system.
“We’re going to continue to see all of these frivolous lawsuits, prosecutions, weaponization of the justice system against a Donald Trump or any politician without any regard for the cost undertaken by the victim,” Concha said. “And in this case $6 million against then-candidate Trump, now-President Trump.”
“Every dime of that 6 million should be paid back, and then next, Jack Smith should pay back all of Trump’s legal bills for wasting his time there, too,” Concha added.
Concha said people saw the prosecutions against Trump for “what it was,” citing 2024 election results.

“The extent they tried to go to try and make Donald Trump not the 47th president of the United States, and everything that he overcame in those 530-plus lawsuits taken against him, to win most of them and then win every swing state and the popular vote,” Concha said.
“Donald Trump and Republicans and conservatives have seen a lot of wins despite Democrats, the ones who say they are going to save the country for democracy’s sake, did everything to destroy democracy, to destroy [Trump], but now he came out the other side,” Concha added
