Cruz Demands Speaker Johnson Impeach ‘Rogue Judges’

Sen. Ted Cruz urged House Speaker Mike Johnson to advance impeachment proceedings against two federal judges, Chief Judge James E. Boasberg adn Judge Deborah L. Boardman, alleging they committed high crimes and misdemeanors. cruz’s letter, announced during a Senate subcommittee hearing on “Impeachment: Holding Rogue Judges Accountable,” accuses Boasberg of authorizing sealed subpoenas and nondisclosure orders tied to Special Counsel Jack Smith’s Arctic Frost probe that targeted members of Congress and violated the Speech or Debate Clause.He cites recently disclosed documents alleging the Justice Department approved subpoenas for congressional phone records despite constitutional concerns. Cruz also criticized Boardman for sentencing the man who attempted to assassinate Justice Brett Kavanaugh to eight years-well below prosecutors’ recommendation-saying the judge gave undue weight to the defendant’s asserted transgender status. Representatives Brandon Gill and Chip Roy have filed articles of impeachment against Boasberg and Boardman, respectively; Cruz urged Johnson to move those articles forward to uphold constitutional accountability and deter judicial misconduct.

Sen. Ted Cruz, R-Texas, is calling on House Speaker Mike Johnson to begin impeachment proceedings against two “rogue” federal judges he argues “have committed high Crimes and Misdemeanors against the Government of the United States.”

“I write to urge the House of Representatives to immediately advance the pending articles of impeachment against Chief Judge James E. Boasberg, United States District Judge for the District of Columbia, and Judge Deborah L. Boardman, United States District Judge for the District of Maryland,” Cruz wrote in a letter addressed to the speaker.

The letter was announced during Wednesday’s hearing by the Senate Subcommittee on Federal Courts, Oversight, Agency Action, and Federal Rights, which was titled “Impeachment: Holding Rogue Judges Accountable.”

In his communique, Cruz focused on Boasberg’s and Boardman’s recent judicial activities, which he claimed are offenses worthy of impeachment and removal from the bench.

Regarding the former, the Texas senator referenced Boasberg’s role in Special Counsel Jack Smith’s Arctic Frost probe, which “ultimately became” Smith’s elector lawfare against Donald Trump. He specifically detailed the D.C. judge’s authorization of “sealed subpoenas and nondisclosure orders targeting sitting United States Senators — including [Cruz himself] — in defiance of the Speech or Debate Clause and the separation of powers.”

As The Federalist’s Margot Cleveland reported, recently disclosed documents showed how the Biden administration “okayed Special Counsel Jack Smith’s subpoenaing congressional phone records knowing the subpoenas were unconstitutional.”

“That same trove of documents,” Cleveland wrote, “also established the illegality of the nondisclosure orders issued by the courts” — namely, from Boasberg — “to prevent the telecommunication providers from alerting the members of Congress of the unconstitutional seizure of their toll records.”

“Judge Boasberg’s orders, issued without credible basis, represent an unprecedented overreach of judicial authority and a partisan intrusion into the independence of the legislative branch,” Cruz wrote.

Turning his attention to Boardman, Cruz highlighted the Maryland judge’s “egregious conduct” in sentencing the man who attempted to assassinate Supreme Court Justice Brett Kavanaugh following the leak of the high court’s 2022 Dobbs draft opinion overturning Roe v. Wade. While prosecutors recommended “no fewer than 30 years to life imprisonment,” Boardman sentenced the wannabe assassin to just eight years behind bars — a decision stemming from her apparent sympathies for the attempted killer’s “transgender” status and concerns about whether he would be placed in a women’s prison (despite being a male).

“Judge Boardman reduced a potential thirty-year sentence to a mere eight years, citing as mitigating the defendant’s self-declared status as a ‘transgender woman’ and expressing concern that ‘she’ would be housed in a male facility,” Cruz wrote. “Judge Boardman’s partisan predilections have overridden her oath to uphold the Constitution and to support and defend its government. By exposing federal judges to the threat of death, Judge Boardman has undermined the very survival of the federal judiciary.”

Articles of impeachment have been formally filed in the House against Boasberg and Boardman by Reps. Brandon Gill, R-Texas, and Chip Roy, R-Texas, respectively.

Cruz went on to note how both incidents showcase “a judiciary that has explicitly ignored its constitutional duties.” He further urged Johnson to move forward and approve the impeachment articles filed by Gill and Roy, arguing that a failure to do so would “teach future judges that ideology excuses lawlessness and that ‘good Behaviour’ is an empty phrase.”

“The Constitution entrusts Congress with the solemn obligation to preserve the rule of law against corruption and decay,” Cruz wrote. “Judicial independence was never meant to shield misconduct; it was meant to ensure fidelity to the law. To defend that principle is an act of constitutional faith.”
