The Biden Administration Backs Down on Gender Transition Surgeries Mandate
The Biden administration has made the decision to no longer pursue the enforcement of gender transition surgeries on Catholic hospitals. This comes as a significant victory for religious freedom and medical professionals.
The case, Sisters of Mercy v. Becerra, arose from a 2016 interpretation of Obamacare that required gender transition surgeries to be performed, even on children, regardless of religious objections. In response, Becket Law, representing the Sisters of Mercy, the University of Mary, and SMP Health System, filed a lawsuit to prevent the rule from taking effect.
The lawsuit also aimed to exempt Catholic hospitals from providing insurance coverage for employees undergoing gender transition surgery. Multiple courts subsequently struck down both parts of the rule, leaving an appeal to the Supreme Court as the last hope for restoration.
“After multiple defeats in court, the federal government has thrown in the towel on its controversial, medically unsupported transgender mandate,” said Luke Goodrich, vice president and senior counsel at Becket Law.
Becket Law, which had previously won a similar case challenging the “transgender mandate,” emphasized the importance of religious doctors and hospitals in providing essential care to those in need. They also highlighted the violation of medical professionals’ conscience and expertise when forced to perform procedures against their beliefs.
Ethics and Religious Liberty Commission President Brent Leatherwood hailed the decision as a victory for both conscience rights and the protection of vulnerable individuals who should not be exploited in the name of the sexual revolution.
The Biden administration’s retreat on this issue coincided with a recent vote by the U.S. Conference of Catholic Bishops to develop new guidelines for the treatment of transgender individuals in Catholic hospitals. The bishops’ position paper emphasized the God-given order of male and female bodies and stated that interventions for gender dysphoria are not morally justified.
This development marks a significant win for religious freedom, conscience rights, and the well-being of patients. It demonstrates the importance of respecting the deeply held beliefs of medical professionals while providing compassionate care.
