Virginia-Based Company Faces Potential $1.2 Billion in Fines
Blackstone Energy Ltd., a Virginia-based company run by the governor’s son, is now at risk of incurring fines of up to $1.2 billion. New court filings, first reported by WRIC, reveal that the company has allegedly violated a consent order after the Virginia Department of Environmental Quality discovered approximately 5,200 gallons of oil spilled across eight different mining sites.
Department of Justice Lawsuit Targets Governor’s Coal Empire
In May, the Department of Justice filed a lawsuit against Governor Justice’s coal empire, seeking unpaid penalties for previous mining law violations. The federal government claims that these violations pose environmental harm and health and safety risks. The suit, filed by the DOJ’s Environment and Natural Resources Division, accuses James C. Justice III and his 13 coal companies of over 130 violations of federal law.
At the time, Justice’s Senate campaign alleged that the lawsuit was politically motivated, stating, “Joe Biden, Chuck Schumer, and the Democrats have seen the polls that show Jim Justice winning this race, and they’re panicking. So now the Biden Justice Department has decided to play politics.”
Continued Legal Troubles for the Governor’s Companies
The governor’s companies are also facing ongoing litigation related to unpaid bills, taxes, and allegations of mistreatment towards employees and creditors. Governor Justice, who switched from being a Democrat to a Republican, has attempted to distance himself from these businesses, claiming that his adult children now run them.
Challenges from Both Republican and Democratic Opponents
Both Governor Justice’s Republican and Democratic opponents are already targeting his personal financial problems in the Senate race. Before facing Senator Manchin, Justice must first win a Republican primary against Representative Alex Mooney (R-WV), who is supported by the conservative Club for Growth.
Mooney has been highlighting the governor’s financial problems, recently posting on social media, “Deadbeat @JimJusticeWV fails to pay taxes yet AGAIN,” referring to a news story claiming that Justice’s coal company owes $124,000 in unpaid taxes in West Virginia.
Democratic Senatorial Campaign Committee Launches Billboards
The Democratic Senatorial Campaign Committee has announced plans to place billboards near Justice’s luxury Greenbrier resort and the Kanawha County Courthouse. The billboards will read “What is Jim Justice Hiding?” and direct viewers to a website exposing Justice’s various scandals. These billboards will remain posted for one month.
“Gov. Jim Justice is the front-runner in this campaign for U.S. Senate, and the polling shows that he beats every other candidate,” said Roman Stauffer, campaign manager for Justice. “Chuck Schumer and the Democrats are panicking and will do everything they can to prop up Alex Mooney, whom they know they can easily beat in the general election.”
Concerns Over Justice’s Financial and Legal Woes
While Senate GOP leadership actively encouraged Justice to challenge Senator Manchin, some Republicans in West Virginia are worried that the governor’s financial problems could become a significant vulnerability. However, recent polling has not yet indicated a negative impact on Justice’s campaign.
“Every day it’s like this drip-drip-drip — it’s legitimately his biggest problem that all his businesses are failing,” said Rob Cornelius, a longtime GOP campaign consultant in West Virginia.
Justice’s Candidacy Divides Republicans
Justice’s entrance into the race has been seen as a major victory for national Republicans, who have been actively recruiting the popular two-term governor. However, a group of conservative members of Congress, including Representative Jim Jordan (R-OH), have recently expressed support for Alex Mooney’s candidacy.
Republican consultants in Washington also have concerns about Justice’s financial and legal troubles, as the National Republican Senatorial Committee considers this race a top opportunity to flip the Senate from Democratic to GOP control.
