Attorneys for Accused Paul Pelosi Attacker Say Trial Must Be Moved
Lawyers representing the man charged in last year’s attack against former U.S. House Speaker Nancy Pelosi’s husband are seeking a change of venue for his federal trial. They argue that the intense publicity surrounding the case in San Francisco has compromised the possibility of a fair trial.
David DePape is scheduled to appear in federal court on Wednesday, and his defense team will request that the trial be moved to the city of Eureka, California. The federal trial is set to commence on November 13.
DePape’s federal public defenders, Jodi Linker and Angela Chuang, argue that the extensive media coverage of the case in the San Francisco Bay Area has tainted the potential jury pool. They commissioned a survey that revealed many prospective jurors already believe DePape is guilty and would be unable to change their opinions.
According to prosecutors, DePape broke into the Pelosis’ San Francisco home on October 28 with the intention of kidnapping the former speaker, who was out of town. Instead, he viciously attacked her 83-year-old husband with a hammer. The shocking act of violence reverberated throughout the political world.
DePape has pleaded not guilty to federal charges of attempting to kidnap a federal official and assaulting a federal official’s family member. He has also pleaded not guilty to state charges, including attempted murder, burglary, and elder abuse. He is currently held without bail, and a date for the state trial has yet to be scheduled.
Linker and Chuang express concerns that potential jurors in San Francisco may be biased against DePape due to the popularity of Nancy Pelosi, who has represented the city in Congress since 1987. They point out that Bay Area media outlets have extensively covered the case, showcasing video footage of the assault on Paul Pelosi, the 911 call, and a police interview with DePape shortly after his arrest.
In January, a California judge denied prosecutors’ request to keep the footage of the attack confidential, leading to its release to the public.
