Smith made a plea to the Supreme Court in December to expedite the case regarding Trump’s claim of presidential immunity, citing “public importance.” However, Gaetz argues that Smith conveniently ignored the “public importance” to the Biden administration of dragging Trump into court before Election Day.
In his filing, Smith emphasized the need for a speedy resolution to the question of presidential immunity. However, Gaetz points out that the right to a speedy trial belongs to the defendant, not the prosecutor or the public, according to the Sixth Amendment.
