Elizabeth Warren Trolled During SCOTUS Arguments on Affirmative Action

Justice Samuel Alito took an apparent jab at Senator Elizabeth Warren during oral arguments on affirmative action cases. 

While asking North Carolina Solicitor General Ryan Park (who is defending affirmative action policies) what is preventing students from claiming racial heritage they don’t have, he posed the question “[what if] it’s family lore that we have an ancestor who was an American Indian.”

When Park replied that it wouldn’t make sense form someone to claim to be Native in those circumstances, Alito quipped “[Suppose] I identify as an American Indian because I’ve always been told that some ancestor back in the old days was an American Indian.” 

Park conceded that it would be pretty unlikely the student was telling the truth in the context. 

Elizabeth Warren infamously claimed to have been Native American when applying to work at Harvard Law School, and the evidence that played a significant role in getting her the job is hard to ignore. At Harvard Law, Warren had the distinction of having graduated from the lowest-ranked law school of all Harvard Law School professors – and nearly all law professors in the entire Ivy League. 

In 2018 Warren finally took a DNA test, which revealed that she was as little as 0.1% Native American, and the Cherokee Nation criticized even that, pointing out that a DNA test is useless to determine Tribal citizenship (which Warren does not have). And for reference, the average white person in America has 0.18% Native DNA (nearly two Elizabeth Warren’s worth).
